("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of the Site and the
purchase of any products offered on the Site. By accessing or using the Site, you agree to be
bound by these Terms.
1. Acceptance of Terms
By placing an order, registering an account, or browsing the Site, you confirm that you are at
least 12 years old or are accessing the Site under the supervision of a parent or legal guardian,
and you agree to these Terms. If you do not agree to these Terms, you may not use the Site.
2. Product Information and Availability
A. Product Description
We strive to be as accurate as possible in the description of our products (activewear,
sportswear, etc.). However, we do not warrant that product descriptions, colors, or other content
on the Site are completely accurate, complete, reliable, current, or error-free. The colors
displayed on your monitor may vary slightly from the actual garment colors due to screen
calibration differences.B. Pricing and Payment
All prices are listed in Indian Rupees (₹) and are subject to change without notice. Prices listed
may or may not include applicable taxes or shipping charges; if not, they will be calculated and
added during the checkout process. We accept various forms of payment, as listed on the Site.
By providing payment details, you represent that you are authorized to use the payment
method.
C. Order Acceptance
Your receipt of an electronic or other form of order confirmation does not signify our final
acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the
right at any time after receipt of your order to accept or decline your order for any reason,
including but not limited to product availability, errors in pricing or product information, or issues
identified by our credit and fraud avoidance systems.
3. Shipping, Delivery, and Risk of Loss
A. Shipping Policy
We will arrange for the shipment of the products to you. We reserve the right to select the
carrier. All shipments are subject to the shipping terms and policies posted on the Site.
B. Risk of Loss
The risk of loss and title for items purchased from the Site passes to you upon our delivery to
the carrier. We are not responsible for lost or stolen packages once delivery confirmation is
provided by the carrier.
4. Returns, Exchanges, and Refunds
Our goal is to ensure you find the perfect fit and confidence in our gear.
A. Return and Exchange Eligibility
Products may be returned or exchanged within 10 days of delivery, provided they meet our
eligibility requirements. Eligible items must be:
● Unworn, unwashed, and in original condition.
● Must have all original tags and packaging intact.
● Innerwear/intimates are final sale due to hygiene.
B. ProcedureTo initiate a return or exchange, you must follow the procedure outlined in our separate Returns
Policy page, which is incorporated into these Terms by reference. We reserve the right to reject
any return that does not meet the eligibility requirements.
C. Refunds
Refunds for eligible returns will be credited back to your original method of payment within 5 - 7
business days after we receive and inspect the returned item.
In case of COD returns, we may send a payout link to your registered email or phone number.
You will need to click this link and provide your bank account details or UPI ID to receive the
refund.
5. Intellectual Property Rights
A. Ownership
The Site and all its content, features, and functionality (including but not limited to all
information, software, text, displays, images, video, and audio, and the design, selection, and
arrangement thereof), are owned by Gorgeous Sports, its licensors, or other providers of such
material and are protected by international copyright, trademark, patent, trade secret, and other
intellectual property or proprietary rights laws.
B. Limited License
You are granted a limited, non-exclusive, non-transferable right to access and use the Site for
your personal, non-commercial use only. You shall not reproduce, distribute, modify, create
derivative works of, publicly display, publicly perform, republish, download, store, or transmit any
of the material on our Site, except as generally permitted by standard web browsing activity.
6. User Conduct and Content
A. Prohibited Use
You agree not to use the Site in any way that violates any applicable laws or regulations.
B. User Submissions
Suppose you submit or post any reviews, comments, feedback, or other content ("User
Content") to the Site, you grant Gorgeous Sports a non-exclusive, royalty-free, perpetual, and
irrevocable right to use, reproduce, modify, adapt, publish, translate, create derivative works
from, distribute, and display such User Content throughout the world in any media. Yourepresent and warrant that you own or otherwise control all the rights to the User Content you
post.
7. Limitation of Liability
To the fullest extent permitted by law, Gorgeous Sports, its affiliates, directors, employees,
agents, suppliers, or licensors shall not be liable for any indirect, incidental, special,
consequential, or punitive damages, including loss of profits, data, use, goodwill, or other
intangible losses, resulting from (i) your access to or use of or inability to access or use the Site;
(ii) any conduct or content of any third party on the Site; or (iii) unauthorized access, use, or
alteration of your transmissions or content, whether based on warranty, contract, tort (including
negligence), or any other legal theory.
8. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of India and the
State of Madhya Pradesh, without regard to its conflict of law principles. Any legal action or
proceeding arising under these Terms will be brought exclusively in the courts located in Indore,
Madhya Pradesh.
9. Changes to the Terms
We reserve the right to update or modify these Terms at any time without prior notice. The date
of the last update will be listed at the top of this page. Your continued use of the Site after any
such changes constitutes your acceptance of the new Terms.
